Terms and Conditions for Smart Outfit

Welcome to Smart Outfit (the "App"), a mobile application that uses AI to create personalized outfit recommendations based on photos of your clothing, helping you organize your wardrobe and share outfits. These Terms and Conditions ("Terms") govern your access to and use of the App on iOS devices. By downloading, installing, or using the App, you ("you" or "User") agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the App.

1. Acceptance of Terms

By using the App, you confirm that you are at least 13 years old, in compliance with the Children’s Online Privacy Protection Act (COPPA). If you are under 18, you must have permission from a parent or legal guardian to use the App, and it is your responsibility to obtain such consent. We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or through other means (e.g., email notifications). Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to these Terms. Certain features, such as advanced outfit recommendations or wardrobe management tools, may require a paid subscription. You may not:

• Modify, reverse-engineer, decompile, or disassemble the App.
• Copy, distribute, or create derivative works from the App.
• Use the App for any unlawful or unauthorized purpose.
• Attempt to gain unauthorized access to the App or its servers.

3. Subscriptions

Some features of the App are available only to users with an active subscription, managed through the Apple App Store. Subscriptions are subject to the following:

• Payment: Subscriptions are billed through your Apple ID in accordance with Apple’s terms and conditions. Prices are displayed in the App before purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple App Store account settings (see Apple’s subscription management guide).
• Access: A valid subscription grants access to premium features for the duration of the subscription period.
• Persistence: If you delete your account, your subscription will remain active unless you explicitly cancel it through the App Store. You are responsible for managing your subscription.
• No Refunds: All subscription payments are non-refundable, except as required by law or Apple’s policies.

4. User Accounts

To access certain features (e.g., saving outfits, sharing content, or premium features), you must create an account using Sign in with Apple or Google Sign-In, powered by Firebase Authentication. You agree to:

• Provide accurate and complete information during registration.
• Keep your account credentials confidential and not share them with others.
• Notify us immediately of any unauthorized use of your account at support@smart-outfit.com.

We reserve the right to suspend or terminate your account if we suspect fraudulent or unauthorized activity.

5. Account Deletion

You may delete your account at any time through the App’s settings. Upon deletion:

• Your account and associated data (e.g., uploaded photos, saved outfits) cannot be restored.
• All user records will be permanently deleted from our servers within a reasonable period, typically within one week, in accordance with our Privacy Policy.
• Your subscription, if active, will persist until you explicitly cancel it through the Apple App Store. Deleting your account does not automatically cancel your subscription.

6. User-Generated Content

The App allows you to upload photos of your clothing, save outfits, and share content with others ("User Content"). By uploading User Content, you:

• Grant us a worldwide, non-exclusive, royalty-free, transferable license to use, store, process, and display your User Content solely to provide and improve the App’s services (e.g., generating AI-driven outfit recommendations or enabling sharing features). This license does not permit us to share your User Content with third parties for purposes unrelated to the App’s services.
• Represent that you own or have the necessary rights to upload and share the User Content.
• Acknowledge that shared User Content (e.g., outfits shared with friends or via social media) may be visible to others as per your sharing settings.

You are solely responsible for your User Content. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable (e.g., offensive or copyrighted images).

7. Prohibited Conduct

You agree not to use the App to:

• Upload or share content that is unlawful, offensive, defamatory, or infringes on the rights of others, including copyrighted or inappropriate clothing photos.
• Interfere with the App’s functionality or security, including by introducing viruses or malicious code.
• Collect or harvest information about other users without their consent.
• Engage in any activity that violates applicable laws or regulations.

8. Intellectual Property

The App, including its design, code, AI algorithms, and content (excluding User Content), is owned by Smart Outfit and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or other proprietary materials without prior written consent.

9. Third-Party Services

The App integrates with third-party services, such as Firebase Authentication for Sign in with Apple and Google Sign-In, social media platforms for sharing outfits, and the Apple App Store for subscriptions. Your use of these services is subject to their respective terms and conditions (e.g., Firebase Terms). We are not responsible for the performance or policies of third-party services.

10. Data Storage

The App uses Amazon Web Services (AWS) servers in Ireland to store and process data, including User Content. By using the App, you consent to the storage and processing of your data in Ireland, as detailed in our Privacy Policy.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your license to use the App ends, and you must delete the App from your device. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, limitation of liability) will remain in effect.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be error-free, secure, or uninterrupted, or that outfit recommendations will be accurate or suitable.

14. Indemnification

You agree to indemnify and hold harmless Smart Outfit and its affiliates, officers, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ireland, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in Ireland, except where prohibited by law. Users in the European Union or California may have additional rights to pursue claims in a court of competent jurisdiction in their country of residence, as provided by applicable laws (e.g., GDPR, CCPA).
